Labour Update - May 2025
Below is a downloadable summary of recent arbitration and adjudication decisions including a salary calculation grievance award. We also included an external legal opinion provided by Joanne Mulcahy (2021), related to compelled disclosure for Subject Officials within a Special Investigations Unit (SIU) investigation. These decisions offer members useful guidance on aggravating/mitigating factors an adjudicator will consider when determining disciplinary penalty, and on joint submissions (or alternatively, the potential to negotiate a settlement under s.202(8) of the CSPA). They also offer insightful commentary on the scope of DFR, reference to the “essential character test” used to determine whether a grievance officer has jurisdiction to hear a matter, and the interplay between Criminal Code and Misconduct offences. The salary calculation grievance award decision (Windsor) discusses methods for calculating 2nd Class Constable salaries and efforts to harmonize wage levels across ranks.
